What to Know Before Buying Car Insurance: A Legal Perspective for Alabama Drivers

July 23, 2025•3 min read

Car insurance isn’t just a legal requirement—it’s your financial safety net. But with so many coverage options, exclusions, and fine print, it’s easy to make mistakes that only come to light after an accident.

At Nelson, Bryan, and Cross, we’ve helped countless Alabama residents navigate the aftermath of car accidents. One common theme? Many drivers don’t fully understand their auto insurance policies until it’s too late. Here’s what you should know before signing that policy.

1. Alabama's Minimum Requirements Aren’t Enough

Under Alabama law, drivers must carry:

  • $25,000 for bodily injury per person

  • $50,000 for bodily injury per accident

  • $25,000 for property damage

This is known as 25/50/25 coverage—and while it's the legal minimum, it’s rarely enough to cover the real costs of a serious accident. Medical bills alone can exceed $25,000 in a matter of hours.

2. Uninsured and Underinsured Motorist Coverage (UM/UIM) Is Critical

Alabama does not require you to carry UM/UIM coverage, but declining it is a mistake. Roughly 1 in 5 Alabama drivers are uninsured. If you're hit by one of them, or by someone with minimal coverage, your own UM/UIM policy may be your only source of compensation.

Ask your insurance agent:

  • What are my UM/UIM limits?

  • Can I increase that amount?

  • Does this apply to hit-and-run situations?

3. What Does “Full Coverage” Really Mean?

Many drivers are told they have “full coverage,” but that phrase is misleading. It generally refers to a combination of:

  • Liability coverage (pays for others if you’re at fault)

  • Comprehensive coverage (non-collision events like theft, weather)

  • Collision coverage (damage to your car in an accident)

However, “full coverage” doesn’t always include rental reimbursement, medical payments, or UM/UIM. Ask for a breakdown of what’s included—and what’s not.

4. Medical Payments Coverage Can Bridge the Gap

Also known as MedPay, this optional coverage helps pay for medical expenses regardless of fault. It’s especially useful if you have a high-deductible health plan or need help covering out-of-pocket costs quickly.

5. Watch for Exclusions and Limitations

Before buying a policy, review:

  • Who is covered when driving your car?

  • Are permissive drivers included?

  • Are there any mileage or usage restrictions?

These fine-print details can make or break your ability to recover damages.

6. You Have the Right to Choose Your Repair Shop

After an accident, insurers may try to steer you toward their preferred body shops. But in Alabama, you have the right to choose who repairs your car—don’t feel pressured.

7. If You’ve Been in an Accident, Call a Lawyer Before You Call Their Insurance

Insurance adjusters often call quickly after a crash. Before giving a statement or signing anything, talk to a lawyer. You could be waiving your rights without realizing it.
